CNN's Erroneous Report on Dietary Supplement Regulation was Corrected After my Complaint and Correction

A recent CNN text report and the accompanying video posted on its webpage asserted that dietary supplements are “unregulated” and that label and ad claims are made without any government supervision.1 The video was shown on the CNN television network. Of course, one need only go to the FDA's own web site to find out that this is false. Even the claim that dietary supplements are "unregulated" compared to other food categories is preposterous.
The FDA says that (I have bolded certain words in these quotes to emphasize that these are mandatory rules, or regulation): "FDA regulates dietary supplements under a different set of regulations than those covering "conventional" foods and drug products (prescription and Over-the-Counter)"
The agency explains the scope of those regulations: "FDA's post-marketing responsibilities include monitoring safety, e.g. voluntary dietary supplement adverse event reporting, and product information, such as labeling, claims, package inserts, and accompanying literature. The Federal Trade Commission regulates dietary supplement advertising...Domestic and foreign facilities that manufacture/process, pack, or hold food for human or animal consumption in the United States are required to register their facility with the FDA."
Regarding the regulation of claims and labels, the agency says: "Claims that can be used on food and dietary supplement labels fall into three categories: health claims, nutrient content claims, and structure/function claims. The responsibility for ensuring the validity of these claims rests with the manufacturer, FDA, or, in the case of advertising, with the Federal Trade Commission...Manufacturers of dietary supplements that make structure/function claims on labels or in labeling must submit a notification to FDA no later than 30 days after marketing the dietary supplement that includes the text of the structure/function claim."
"The Federal Trade Commission (FTC) regulates advertising, including infomercials, for dietary supplements and most other products sold to consumers. FDA works closely with FTC in this area, but FTC's work is directed by different laws. For more information on FTC, go to: http://www.ftc.gov/bcp/
Advertising and promotional material received in the mail are also regulated under different laws and are subject to regulation by the U.S. Postal Inspection Service."
Regarding new ingredients, the agency says, "The Dietary Supplement Health and Education Act (DSHEA) requires that a manufacturer or distributor notify FDA if it intends to market a dietary supplement in the U.S. that contains a "new dietary ingredient." The manufacturer (and distributor) must demonstrate to FDA why the ingredient is reasonably expected to be safe for use in a dietary supplement, unless it has been recognized as a food substance and is present in the food supply." This rule does not apply to other food categories.
Additionally, serious adverse event reporting (SAERs) is no longer voluntary. Manufacturers are required to report SAERs to the FDA within 15 business days of receipt, another distinction between dietary supplement regulation and rules for other regulated food categories. And the FDA, as authorized by DSHEA, is phasing in mandatory cGMPs (current Good Manufacturing Practices) for all dietary supplement manufacturers, focusing on assuring safety and proper identification of ingredients by setting strict rules for manufacturing procedures. This is another important regulatory distinction between dietary supplements and other food categories.
POSTSCRIPT:
I sent a short version of this correction to CNN on Monday, 1/14/08, and posted a long version on my blog. To their credit, CNN has now (1/17/08) posted a link to my blog entry1 that had complained about the accuracy of its original report regarding vitamins and supplements, has revised its text version on the CNN webpage to remove the errors that I pointed out to them and insert accurate quotes from the FDA website, and has pulled the video of that original report from the CNN webpage.2
I acknowledge CNN’s corrections as responsible and applaud its efforts to quickly correct these errors when informed of them.
My hope is that CNN will now be more vigilant in recognizing and challenging the common misperception that “dietary supplements and the vitamin industry are unregulated”, since even a quick fact check reveals that this is quite untrue. Even when those making these false claims are authorities, “experts” or health professionals, it would be helpful if journalists learn that such blanket condemnations about the vitamin and supplement industry are ‘red flags’ indicating that sources may be spouting personal opinions that may be inaccurate, biased, inflammatory, or even potentially libelous; and hopefully triggering a healthy skepticism instead of a mere echo.

Recovering from Squamous Cell Cancer of the Eye and Lid

I had my right eye removed due to squamous cell skin cancer on September 26, 2007. I doubt that I will ever forget that day, but let me back up a little.
When I was 18 years old, I received a pair of contact lenses as a High School graduation (1962) present. They were the hard lenses and took some getting used to, but it was a love affair from the beginning. I had worn glasses due to progressive myopia since I was 11 years old. Using those contact lenses made my peripheral vision and sight in general nearly perfect.
For many years, I enjoyed my lenses, always getting exams for any problems that may have occurred and, of course, new prescriptions as the years went by. Over the course of the years, I had more than one eye infection. I always removed my lenses for a week or two, used the medication prescribed by the doctors and when the condition healed, I happily put my lenses back in.
When I was 40, my husband and I left Chicago, IL and moved to Phoenix, AZ, where I live now. My new Ophthalmologist in Phoenix decided to look under my right eyelid since I was complaining of a slight irritation in that eye. He told me I had worn contact lenses long enough. He gave me medication to clear up the irritated spot under my upper lid. He told me he did not like contact lenses, especially the hard ones and told me to stop wearing them altogether. I did not listen and went to another doctor and got soft lenses. My eye felt better for a time but eventually I developed an itchy spot in the corner of my eye.
After consulting with several ocular specialists, I was diagnosed with squamous cell of the lid. In addition, upon removal of layers of the lid looking for margins and roots ending, I had to have my eye completely removed, this is called exenteration. From the information I had gathered, if these people were telling me this was my best course of action, I was listening. Later that week I had my surgery and it went smoothly. After several months following my exenteration, my life has started to go back to normal.
For the first six weeks after surgery, I have had a couple of negative days. I did not dwell on the negative side long because it was not going to make the cancer go away or bring my eye back. I have kept a positive attitude and have had wonderful, wonderful support from family, friends and colleagues. So far, the biggest difference I see is some lost peripheral vision on my right side. Now my husband can sneak up on me more easily so I guess I will have to learn to turn my head more. Steps can be a problem and have banged my head on open cabinet doors. I am learning. I do not see this as any kind of handicap. I am a very positive person and I think that has helped.
I went to an oncologist and dermatologist, both of which say I have no signs of the cancer having spread to other parts of my body whatsoever. I like to think my immune system was strong due to all the vitamins and supplements I have taken over the years and still take today.
Each morning I thank God for my left eye. I still drive legally in the state of Arizona and continue with my new love affair – the computer.

12 Ways to Eliminate Sugar From Your Diet

Fact or Fiction About Supplements
Myth 1. Dietary Supplements Are Unregulated
- The Dietary Supplement Health and Education Act of 1994 (DSHEA) gave the U.S. Food and Drug administration the power to ensure dietary supplements are safe, properly labeled and that the claims they make are substantiated.
- In addition, supplements are also regulated in each of the 50 states. Virtually all facets of supplements manufacturing, labeling and marketing are covered by extensive regulations issued and enforced by the FDA and the FTC.
Myth 2. Dietary Supplements Are Unsafe and Dangerous
- The U.S. Food and Drug Administration and DSHEA can remove any dietary supplement from the market immediately if it believes it presents a public health hazard.
- According to the reports from the poison control centers throughout the US, adverse reactions to drugs are more than 800 percent higher than those of dietary supplements.

Myth 3. Dietary Supplements Do Not Work

- Potassium citrate supplements could boost bone mineral density.

CoQ10 - Ease Gum Disease
Gum disease or gingivitis, leads to painful, swollen gums, bad breath, and even potential loss of teeth. Brushing and flossing frequently, as well as, regular cleanings are essential for preventing this condition.
COQ10 is found in every cell of your body, especially the heart and gums. Low levels of this essential enzyme have been linked to periodontal disease. In one study a periodontal specialist discovered that people with diseased gums had an unusually large deficiency of coenzyme Q-10. Once they were supplemented and had their blood serum levels of CoQ10 increased, the gum conditions reversed.
Banish Cancer Sores
Some people with recurrent mouth ulcers have been reported to respond to lactobacillus acidophilus.
Take 1,000 milligrams of the amino acid lysine at each meal during an outbreak and then 500 milligrams at each meal for a week afterward.
Rub the liquid from a vitamin E capsule directly on the sore. Apply it three times a day during an outbreak until the sore heals.
Take 4,000 to 5,000 milligrams of vitamin C daily during outbreaks of canker sores and at least 500 milligrams daily as a way of preventing them. Zinc lozenges help resolve canker sores by supporting the immune system.
Calcium supplements help counteract the over acidity.
Sweeter Breath
Bad breath, or halitosis, affects about half of the population at one time or another.

High stress levels and daily alcohol consumption also demonstrated a significant impact on periodontal disease progression.
